| I recently recorded a track with my first sample attempt. It came out alright, so I've been looking into trying to get the sample cleared so I put it own my Myspace page. I've read alot of info that has brought up some questions. Has any one here ever gotten a sample cleared for a track that you did not plan on releasing? If so, is it pretty expensive. I see the rates vary depending on the intent, popularity of the artist, and how much you use (amongst a lot of other factors). What about the sample battles and re-makes on this site. I read that re-makes / re-creations violate the writer or creators copyright even if the vocals aren't used (wich would be an additional infringement on the performer and record company's recording). Is there something about the way they are being used on web sites that make clearing not necessary? Thanks | | | |

But for a big record company to come after someone who made a track for fun and uploaded it to show his/her friends on myspace. Is way more expensive than what they could ever dream of getting out of you in court. So to avoid this, they usually don't. | | | |

Why is that? Also, I don't profit of it? There's still a very small chance they will go after me for something that underground though, I guess.

| | It's the same answer as above, the big companies are not likely to go after the little fish. But to be on the right side of the law, you would need to clear the mixtape. The clearence issue is still there, like it is with your sampled track. Even if it is free, the samples and artist should still be cleared. | | | |
